I don't know about polish law but in the US he cannot be shot unless he is a threat to others.

if hes running away the cops can do w/e they want really to bring the guy down, they wont shoot him with real bullets but they will shoot him with a bean bag bullet which would take his ass down, if not a few more would do the job.
