At least in the US, if the two of them are under 18, it doesn't matter how much you both agreed to it. It's still illegal and if one of them were to go to the police and say the other raped him/her. The police would believe it was true, even if you were both in agreement.

In Shurts case, he's 16 while his g/f is 14. Thats not technically "legal" if they did anything, hence if say her parents caught them, he can be charged for a smaller rape charge

Thats pretty much the point. Not many kids are gonna ask their parents if they can have sex, therefore it defeats the purpose of the "law".
